Disputes

Litigation

Civil, commercial, constitutional and human rights litigation in courts at every level, including the Supreme Court of Nigeria.

Overview

Litigation is often the last resort but sometimes the only one. We prepare cases thoroughly, give clients a candid view of their prospects, and represent them at trial and on appeal.

We act in commercial and contractual disputes, banking and debt recovery, land and property, constitutional and administrative law, and the enforcement of fundamental rights. We appear before State High Courts, the High Court of the FCT, the Federal High Court, the National Industrial Court, the Court of Appeal and the Supreme Court, and before the ECOWAS Community Court of Justice.

Our cases include the challenge to the implementation of the Naira redesign policy at the Supreme Court in 2023 and the Apo Six human rights case. We also advise on settlement and alternative dispute resolution where that serves the client better.

FAQs

It depends on the subject matter and the parties. The Federal High Court has exclusive jurisdiction over matters such as federal revenue, companies, intellectual property, admiralty and actions against federal agencies, while most other civil claims go to a State High Court or the High Court of the FCT.

Often a short one. The Public Officers Protection Act requires most actions against public officers and agencies to be brought within three months, and some statutes require pre-action notice.

It varies widely. Simple debt claims under the undefended list or summary judgment procedure can be quick, while contested trials and appeals can take years. We give an estimate for each case at the outset.
